Terms of Service

Governed by the laws of the United Arab Emirates.

Introduction

These Terms of Service govern your access to and use of the BiteCloud platform. By creating an account or using any part of the platform, you agree to be bound by these terms. If you are entering into these terms on behalf of a business, you represent that you have the authority to bind that business to these terms.

Definitions

  • Platform: the BiteCloud software, applications, APIs, and related services
  • Operator: a business or individual subscribing to BiteCloud under a paid or trial plan
  • User: any individual accessing the platform on behalf of an operator
  • End customer: an individual interacting with operator-configured channels powered by BiteCloud
  • Content: all data, text, images, and information submitted to or generated by the platform

Account Registration

Operators must provide accurate and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. BiteCloud must be notified immediately of any unauthorized access or security breach.

Subscription and Payment

BiteCloud is offered on a per-outlet monthly or annual subscription basis. Pricing is as published on the pricing page at the time of subscription. Subscriptions are billed in advance. Annual subscriptions are non-refundable except where required by applicable law. Monthly subscriptions may be cancelled at any time, with access continuing until the end of the current billing period. BiteCloud reserves the right to modify pricing with 30 days written notice to active subscribers.

Free Trial

BiteCloud offers a free trial period for new operators. No payment information is required during the trial. At the end of the trial period, continued access requires selection of a paid plan. BiteCloud reserves the right to modify or discontinue the free trial at any time.

Acceptable Use

Operators agree to use the platform only for lawful purposes and in accordance with these terms. The following are prohibited:

  • Using the platform to process fraudulent transactions or facilitate illegal activity
  • Attempting to gain unauthorized access to any part of the platform or its infrastructure
  • Interfering with the operation of the platform or other users' access
  • Reverse engineering, decompiling, or attempting to extract the source code of the platform
  • Reselling or sublicensing access to the platform without written authorization from BiteCloud

Data Ownership

Operators retain full ownership of their operational data, customer data, and content submitted to the platform. BiteCloud does not claim ownership over operator data. BiteCloud is granted a limited license to process operator data solely for the purpose of providing the platform services. Upon account termination, operator data is retained for 36 months and then permanently deleted, unless an earlier deletion is requested.

Intellectual Property

BiteCloud and its licensors retain all intellectual property rights in the platform, including software, design, trademarks, and documentation. Nothing in these terms transfers any intellectual property rights to the operator. Operators are granted a limited, non-exclusive, non-transferable license to use the platform for their internal business operations during the term of their subscription.

Service Availability

BiteCloud targets 99.9% platform uptime excluding planned maintenance. Planned maintenance will be scheduled during off-peak hours with advance notice where possible. BiteCloud does not guarantee uninterrupted service and is not liable for downtime caused by factors outside its reasonable control.

Limitation of Liability

To the maximum extent permitted by applicable law, BiteCloud's total liability to an operator for any claim arising from or related to the platform shall not exceed the total fees paid by that operator in the three months preceding the claim. BiteCloud is not liable for indirect, incidental, consequential, or punitive damages, including lost revenue, lost data, or business interruption.

Termination

Either party may terminate the subscription at any time. BiteCloud may suspend or terminate access immediately if an operator breaches these terms, fails to pay fees when due, or engages in conduct that poses a risk to the platform or other users. Upon termination, the operator's access to the platform will cease and data retention will follow the schedule outlined in the Privacy Policy.

Governing Law

These terms are governed by the laws of the United Arab Emirates. Any disputes arising from or related to these terms shall be subject to the exclusive jurisdiction of the courts of the UAE, unless otherwise agreed in writing between the parties.

Changes to These Terms

BiteCloud reserves the right to update these terms at any time. Operators will be notified of material changes with at least 14 days notice. Continued use of the platform following the effective date of changes constitutes acceptance of the updated terms.
